On 28th of May, Supreme Administrative Court (NSA) passed a judgement which confirmed the decision of Provincial Administrative Court(WSA) in Warsaw and supporting decision of the Patients Ombudsman. The Patients Ombudsman claimed that the practise of one of the hospitals which consist of determining which biological medicine received patient on the result of the auction, is incompatible with medical knowledge and it is a violation of patients’ rights. The practise of automatically substitute biological medicine without doctor participation, has been challenged. The case has a precedent character and might set clear standards of use of biological medicine in hospitals, where the decision of a doctor regarding continuation or changing therapy should be the most important. In that case Monika Duszyńska was honoured to be representation of Polish Union Organization of Patients “Obywatele dla Zdrowia” , one of the three social organizations, which proceeded to the procedure regarding defence of decision of Patients Ombudsman.
