Monika Duszyńska, delivering legal services under the name Monika Duszyńska Kancelaria Adwokacka with its registered office in Warsaw (Poland), at ul. Rydygiera 13, app. 271 (01-793 Warsaw), NIP (Tax ID) 9521642711 (hereinafter: “Law Office”) is the controller of your personal data.

Objectives and scope of data

Your personal data will be processed by our Law Office exclusively in connection with the performance of the agreement on the provision of legal services, either verbal or written, to perform certain activities before concluding such agreement (pursuant to Art. 6(1)(b) of General Data Protection Regulation, “GDPR”), and for accounting purposes (pursuant to Art. 6(1)(c) of GDPR). In addition, your data will be processed for the purposes of legitimate interests pursued by the controller, in particular marketing of our legal services (Art. 6(1)(f) of GDPR).

We apply technical and organizational measures that guarantee the security of processing your data, implementing the key provisions expressed in GDPR and in other applicable regulations.

Respecting the rights

At your request, you may obtain access to your personal data, as well as request rectification, erasure or restriction of processing them. As part of the implementation of the provisions of the GDPR, we observe your right to data portability and your right to object to their processing. In case your personal data are processed unlawfully, you have the right to make a complaint to the President of the Office for Personal Data Protection.

Storage of personal data

We store your data for a period not longer than necessary to achieve the purposes for which the data are processed. In compliance with GDPR, your personal data will be processed for a time required to perform necessary steps before concluding the agreement on legal services, for the term of this agreement, and then for the time corresponding to the limitation term of the claims resulting from this agreement, or for the period of 5 years following the last invoice has been issued, whatever is the longer term. With regard to data processing for the purposes of legitimate interests pursued by the controller and for accounting purposes, the data will be processed for a maximum legally authorised period, having regard, however, to your right to object to their processing, in accordance with the provisions of GDPR.

Categories of personal data and how we collect them

Our Law Office processes the following categories of personal data: name(s) and last name, address, phone number, e-mail, company, tax identification number, bank account number (also a PESEL number and place of residence, in the case of clients being individuals). We may obtain your personal data directly from you, but also from clients and business partners of the Law Office, other persons, courts and public administration bodies, as well as from other persons in connection with the provision of legal services and for the purposes of legitimate interests pursued by the controller.

Recipients of data

Entities to which your personal data are disclosed, for the purposes strictly related to the processed data objectives, become the recipients of the data. Recipients include our employees and lawyers, as well as entities to which our Law Office will entrust the processing of data, and employees and associates of these entities. Government and judicial authorities may also become recipients of your data if we are required legally to disclose them your data.

Transfer of data

The transfer of your data to a third country will take place only if it is necessary for the provision of legal services by our Law Office. We ensure that the appropriate safeguards to protect your data during such a transfer are maintained.
